Dispute Resolution Guidelines and Information Gathering Policy – Ofcom update

Ofcom has published a statement on Dispute Resolution and revised Dispute Resolution guidelines. The revised guidelines simplify the dispute resolution process, making it more efficient and effective.

This seems to be a response to a rise in disputes being submitted to Ofcom, but also a mention of the government spending review highlights the need to reduce resources applied in resolving these often complex and contentious disputes.

They’ve also published an update on their information gathering policy. This incorporates changes to the Communications Act 2003 and Wireless Telegraphy Act 2006 as a result of the revised European Telecoms Framework.

Ofcom’s monthly update – April 2011

Ofcom have carried on implementing changes that were raised during their consultation in relation to the mobile termination rates (MTRs).

In this update they highlight their guidance being given to smaller mobile communication providers in order to resolve any disputes over what are fair and reasonable charges.

‘On 15 March 2011 Ofcom announced a reduction in MTRs – the wholesale charges that mobile operators make to other operators to connect calls to their networks – which came into effect on 1 April. During the consultation process, Ofcom recognised that smaller mobile communications providers would need to agree fair and reasonable MTRs with originating communications providers (the network from where the call was initiated).’

Dispute concerning BT’s transit charges to particular mobile network operators – case closed

The dispute between BT and Cable & Wireless, Gamma Telecom Holdings Ltd, Colt Technology Services, Verizon UK Limited and Opal Telecom has been closed. This was over the repayment by BT of certain charges for the transit of traffic terminating with particular mobile network operators during different periods between September 2006 and March 2007.

The case began back in June when Ofcom was asked to resolve these disputes under section 185(1) of the Communications Act 2003 (the Act).

On 20 October 2010, Ofcom issued final determinations under sections 188 and 190 of the Act resolving these disputes to the parties in dispute and the party which registered as an interested party.

Review of Alternative Dispute Resolution Schemes – Call for Inputs

All communications providers are required to be a member of an approved Alternative Dispute Resolution (ADR) Service.  ADR Schemes are free, independent resolution services available to consumers who have not been able to resolve complaints with their communications provider.  The current approved ADR Schemes are CISAS and Otelo.

Ofcom is obliged to keep its approval of ADR Schemes under review.  This Call for Inputs provides stakeholders with the opportunity to give their views of the current ADR Schemes.
